These privacy policies also advise you about your rights and choices with respect to your personal information, along with how you can reach us regarding privacy questions.

To help inform you, we provide this notice explaining our online information practices and the choices you can make about the collection and use of information you submit or we collect through our websites and our other related Michaela! mobile applications (each an “App”) and your use of other interactive features, plug-ins, mobile websites, content, downloads, services, tools, and other online services that we own and control and that post a link to these this Privacy Policy (collectively, with each App and Site, the “Service”). We are the data controller of the personal data that we collect from you and process for our own purposes. Where we refer to affiliates in the following, this also includes joint venture partners.

Under the laws of some countries outside the European Economic Area, we may need your consent to our processing of your information set forth in this Privacy Policy. Subject to any indications you may give us to the contrary, such as opting out or not opting in if asked, and where permitted by law, by providing information or otherwise interacting with our offerings, you consent to our use of information in accordance with this Privacy Policy.

In addition, please review the Service’s Terms of Use, which governs your use of the Service. If you do not agree to the terms of this Privacy Policy, please do not provide us with any information and do not use this Service. To the extent we provide you notice on our Service of different or additional privacy policies or practices (e.g., at the point of our collection), those additional terms shall govern such data collection and use.

1. Information We Collect

(a) Registration and Account Information:

If you register for an account with us (including through third-party login credentials as described in Section 1(c) below), you will be asked to provide information such as your name, email address, phone number, and address. When you sign-up for an account, create a profile, purchase products or services, or otherwise engage with our Service, you may provide additional information. You may also be able to upload photographs for your account/profile if we make this functionality available from time to time. To protect users on our own Services, we may use third party service providers and/or third-party software to moderate chat among our users. Please see our House Rules for more information related to your participation in Michaela! online communities. These moderation services may include recordings of text chat for purposes of avoiding or addressing potential abuses of our terms of use or other concerns on behalf of our users. We may also use third party service providers and/or third-party software to record text chat to help address customer service inquiries.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

(b) Information to Respond to Your Requests:

You may give us information such as your email address so we can send you newsletters and other communications. Details of how you can opt-out of receiving any communications from us are detailed in the section headed “Your Choices” below.

(c) Social Media Information:

We may now or in the future offer sign-in services that allow you to use third-party login credentials to access the Service. We also may offer services that allow you to disclose information with third-party social media websites such as Facebook, Instagram, TikTok, Twitter, and others. Their policies govern the use of your personal information when you choose to access the Service using their sign-in services.

When you link your account or engage with our Service through third-party social media sites, you understand that you may be allowing us to have ongoing access to certain information stored on those social media sites (e.g., your public profile, friend list, people you follow or who follow you, your email address, birthday, interests, current city, likes, information about your friends, etc.). We may receive certain information about you which is stored on social media sites if other users of those sites give us access to their profiles and you are one of their friends or connections depending upon your settings on those third-party social networking sites. The information we have access to from the third-party social media websites varies by website and is controlled by your privacy settings on those websites. We may also receive other information (e.g., content viewed and information about the advertisements within the content you have been shown or may have clicked on, etc.) from your interaction with our Service. You agree that we may disclose your video viewing with or obtain information about your video viewing from analytics providers, advertising partners and third-party social media sites for two years or until you withdraw consent. By associating an account managed by a third-party with your account and authorizing us to have access to this information, you agree that we may collect, use, and store information from these websites in accordance with this Privacy Policy.

(d) Information About Others/Inviting Friends:

From time to time you may choose to submit information about other people to invite them to join the Michaela! community. Inviting friends is always optional. You should check that your friends consent to your disclosure of their information before submitting it to us.

(e) Information From Other Sources:

We may receive information about you from your friends and others that use the Service, such as when they submit your information to us about you, if for example, they use send-to-a-friend functionality available on the Service. Additionally, we may, from time to time, supplement the information we collect directly from you on our Service with outside records from third parties for various purposes, including to enhance our ability to serve you, to tailor our content and ads to you and to offer you opportunities that may be of interest to you. The information we collect may be combined with information from outside records (e.g., demographic information, navigation information, and/or additional contact information) that we have acquired from and about you, consistent with applicable legal requirements.

(f) Mobile Information:

We may collect additional information from you if you access our Service through a mobile device (e.g., your unique device identifier, device’s operating system, mobile carrier, general location or your location).

Nielsen Measurement Information
Our properties may feature Nielsen proprietary measurement software, which will allow you to contribute to market research, such as Nielsen TV Ratings. (g) Technical Usage Information:

When you visit our Service, we collect usage information sent to us by your computer, mobile, or other access device that tells us how you are using the Service (“usage information”). In collecting Information about your use of a Service, we may use service providers or other solutions to record users’ interactions with our Sites, which may include mouse clicks, mouse movements, page scrolling, and keystrokes/key touches during those sessions. We use these recordings to diagnose issues and identify areas for improvement and further engagement. We use tracking technologies (including cookies (including cookies stored in HTML-5), web beacons/GIFs, embedded scripts, e-tags/cache browsers) to collect usage information.

We may also collect password information from you when you log in, as well as computer and/or connection information. During some visits we may use software tools to measure and collect session information, including page response times, download errors, time spent on certain pages and page interaction information.

(h) Geolocation Information:

When you visit the Service, we may collect geolocation information to provide certain location-based services that you request (e.g., maps) or any of the reasons set forth in Section 2 of this Privacy Policy. 2. Uses and Retention

We use the information we collect from and about you for the following purposes:

(a) Operate Our Service:

We use the information collected to: (i) respond to your requests (including career applications); (ii) provide customer service (e.g., to resolve disputes, problems with your account/profile or the Service); (iii) to process, track and complete transactions; (iv) personalize your experience by providing content on the Service, including targeted advertising that we believe is relevant to you; (v) improve the Service, marketing endeavors and our service offerings; (vi) give you information about your account; (vii) provide you with a safe, efficient, and customized experience; (viii) comply with our legal obligations, or to establish or exercise our legal rights or defense against legal claims; (ix) to enable you to participate in a variety of the Service’s features such as to enable you to participate in online surveys, entry sweepstakes, contests or other promotions; (x) to contact you with regard to your use of the Service and, in our discretion, changes to the Service and/or Service’s policies; (xi) to measure and analyze audience traffic and to improve the overall experience at the Service and our merchandise and services; to understand whether you read our communications and clicked on links within those messages; (xii) to develop aggregated data and statistics; (xiii) to support other internal business operations; and (xiv) for purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.

In countries where our processing of Information requires a lawful basis, we rely upon the following:

  • Much of our processing, such as providing, and maintaining our Services, is necessary for entering into, or the performance of, the contract we have with you, including enabling new customers to sign-up or register with us and existing customers to log-in to our Services
  • Other types of processing are necessary for our ‘legitimate interests’ (and those of others), including: Running our business, providing our offerings and serving our customers; Personalizing content and making recommendations for other content; Exercising and/or enforcing the rights granted to us under the terms and conditions of the offering; Facilitating payment for our offerings; Improving and developing our offerings; Creating efficiencies in our business; Understanding consumer trends and interests, including through customer insights, market research, and measurement of content performance; Compiling statistics about the use of our offerings.
  • Some types of processing activities will be necessary for us to perform our contract with you to provide an offering.
  • Some types of processing activities will be necessary to comply with our legal obligations.
  • Some types of processing will be necessary for our legitimate interests (or those of others), including: Responding to our customer queries and complaints; Tracking the progress and effectiveness of our response; and Improving our customer Services.
  • For other types of processing we may rely on your consent (where given).

(b) Create De-Identified and Aggregate Non-Personal Information:

We de-identify and or aggregate information about our users such that the information can no longer be used to individually identify them and use such information to analyze Service and user behavior and prepare aggregated reports. We may disclose aggregated, de-identified, and non-personal information, such as aggregated user statistics, to our partners, advertisers, and any other third parties in our discretion. Our use of this information is not subject to this Privacy Policy.

We use information to prevent, detect, and investigate fraud, security breaches, potentially prohibited or illegal activities, and enforce our Terms of Use.

(d) Communicate With You:

We use your information to contact you to maintain the Service, your account, your job applications, to comply with your stated communication preferences, to provide other services requested by you, as described at the time when we collect the information from you, to send you information such as to send you electronic newsletters or to provide you with special offers or promotional and marketing materials on behalf of us or third parties, including to let you know about upcoming events, or contact you for other purposes authorized by law.

In countries where our processing of Information requires a lawful basis, we rely upon the following:

  • These types of activities are necessary for our legitimate interests (and those of others), including: Contacting customers or applicants with important notices or updates; and contacting customers about their transactions, purchases and competition wins.

We retain the information we collect from and about you for as long as it is necessary and relevant for our operations, and in accordance with applicable legal requirements. You consent to our retention of your video viewing tracking data for as long as permissible under applicable law. We have detailed internal retention policies that set out the various retention periods for different categories of information, depending on our legal obligations and whether there is a commercial need to retain the Information. After a retention period has lapsed, the Information is securely deleted, unless necessary for the establishment, exercise or defense of legal claims. Information collected on the Service may be disclosed with:

(a) Michaela Productions, Inc.

We may disclose the information we collect about you with the Michaela! and our affiliates and subsidiaries, as well as with third-party suppliers. The information may be disclosed to: (i) provide joint content and our services (e.g., registration, transactions, analytics and customer support); (ii) help detect and prevent potentially illegal acts, violations of our policies, fraud and/or data security breaches; and (iii) guide decisions about our, Michaela! or a third-party’s products, sites, applications, services, tools and communications. Members of our corporate family will use this information to send you marketing communications and you will have the opportunity to opt-out in email communications. 

(b) Service Providers:

We may disclose your information to service providers under contract who help with our business operations (such as, but not limited to, data hosting services, payment processors, fraud investigations, advertising, site analytics and operations).

(c) Other Entities with Your Consent:

Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service). On the Service, you may have opportunities to express interest in or register for other services. If you do, we will provide information about you to those third-parties, or parties working on their behalf, to implement your request.

(d) Legal and Law Enforcement:

We may provide your information to law enforcement, governmental agencies, or authorized third-parties, in good faith in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other Michaela Media user to legal liability. In such events, we will only disclose information relevant and necessary to the investigation or inquiry, such as name, city, state, zip code, telephone number, email address, user ID history, IP address, fraud complaints and anything else we may deem relevant to the investigation.

(e) Change of Control — New Owners:

We may disclose your information with other business entities, should we plan to merge with, exchange assets with, or be acquired by that business entity. We may also disclose your information as part of the diligence performed as part of such a transaction. Should such a combination occur, we will make reasonable efforts to request that the new combined entity follow this Privacy Policy with respect to your personal information. If your personal information would be used contrary to this policy, we will request that the new owner provide you with prior notice in accordance with applicable legal requirements.

(f) Ad Networks:

On the Service, we may allow third parties to serve advertisements, provide us with data collection, reporting, ad response measurement, and Service analytics, and assist with delivery of relevant marketing messages and advertisements. These third parties may view, edit, or set their own tracking technologies/cookies. The use of these technologies by these third parties is subject to their own privacy policies and is not covered by this Privacy Policy. They might also obtain information about other applications that you have downloaded to your mobile device, the other websites you visit and other information about you or your device in order to analyze and serve targeted advertising on the Service and elsewhere. The effect of an opt-out may be to stop targeted advertising, but it may still allow the collection of usage data for certain purposes (e.g., research, analytics and internal online services operation purposes).

We may use third parties such as network advertisers and ad exchanges to serve advertisements across the Internet and may use third party analytics service providers to evaluate and provide us and/or third parties with information about the use of these ads on third party websites and viewing of ads and of our content. Third parties may offer you a choice as to whether or not to have your information collected for that purpose. You may see certain ads on our Service as well as on other third-party websites across the Internet because we participate in advertising networks administered by third parties. These networks track your online activities over time and across third party websites by collecting information through automated means, including through the use of the tracking technologies described elsewhere in this Privacy Policy, and they use this information to show you advertisements (including our ads) that are tailored to your individual interests. This collection and ad targeting takes place both on our Service and on third-party websites that participate in the ad network, such as websites that feature advertisements delivered by the ad network. This process also helps us track the effectiveness of our marketing efforts. We and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as a Google Ads cookie) together to report how your ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to our Service. Third-party tracking technologies are not controlled by us, even if they use our technology to help store or collect data. Statements regarding our practices do not apply to the methods for collecting information used by these third-party advertisers and others or the use of the information that such third parties collect. We do however work with third parties to make efforts to provide you with information on their practices and any available opportunity to exercise choice. The relevant third party’s terms of service, privacy policy, permissions, notices and choices should be reviewed regarding their collection, storage and disclosure practices. We make no representations regarding the policies or practices of third-party advertisers or advertising networks or exchanges or related third parties. Further, while we may use a variety of companies to serve advertisements on the website, you may wish to visit http://www.networkadvertising.org/choices, which provides information regarding this practice by Network Advertising Initiative (“NAI”) members, and your choices regarding having this information used by these companies, including the “opt-out” procedures of NAI members. Opting out of one or more NAI members only means that those NAI members no longer will be allowed under their own rules to deliver targeted content and/or ads to you, which will affect this and other sites, but does not mean you will no longer receive any targeted content and/or ads. Also, if your browsers are configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different device or change web browsers, your NAI opt-out may not, or may no longer, be effective. (g) Companies in The Mobile App Industry:

If you access the Service through a mobile device, we may also disclose your information with carriers, operating systems and platforms.

(h) Information You Disclose on the Service

If you post photos, comment on content, or participate in online forums or communities, or when you interact with our Service through social media sites, plug-ins or other applications, depending upon your privacy settings, this information may become public on the Internet. We cannot prevent or control further use of this information. You can control what data you disclose through privacy settings available on some social media sites. Please refer to those third-party sites’ privacy policies and terms of use to learn more about their privacy practices, which we do not control.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year. If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Account holders can review and change certain information about them in accordance with applicable legal rights at any time by accessing their accounts on the Service. You should promptly update your information if it changes or becomes inaccurate. We may retain some information from closed accounts so that we can comply with law, prevent fraud, assist with investigations, resolve disputes, analyze, or troubleshoot programs, enforce our Terms of Use, or take other actions permitted by law.   • Delete certain personal information we have about you;
  • Opt out of the sale of your personal information;
  • Opt out of the processing of your personal information for targeted advertising purposes;
  • Request correction of your personal information; and
  • Provide you with information about the financial incentives that we offer to you, if any.

Please note that certain information may be exempt from such requests under applicable law. For example, we need certain information in order to provide the Service to you.

Verification: We will take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, e-mail address, and physical address.

You may also be permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent’s request. If we deny your request in whole or in part, you may have the right to appeal the decision. In such circumstances, we will provide you with information regarding the appeals process.

You also have the right to lodge a complaint with your local data protection authority in the UK or the EEA if you believe we have not complied with applicable data protection laws. The relevant local authority differs depending on your country of residence. For the EEA you may refer to the website of the European Data Protection Board and for the UK to the website of the Information Commissioner’s Office to find out more about how to contact your local data protection authority. You may under certain circumstances also seek a remedy through local courts, if you believe your rights have been breached.

Requests under Privacy Laws: to submit these requests, please use our Contact form, or, if you prefer, you may email us direct at [email protected]. Please note that we may require you to provide appropriate documentation to support your correction request, which we will use only for purposes of actioning your request.

Opt Out of “Sale” of Personal Information or Processing of Personal Information for “targeted advertising”: Depending on your US state of residence, you may have the ability to opt out of the “sale” and/or “sharing” of your personal information to third parties or the processing of your personal information for “targeted advertising” purposes (as such terms are defined under applicable law). Please click the link labeled “Do Not Sell or Share My Personal Information” in the footer or settings menu of the Service to exercise these choices.

Consent: If you have given us your consent, you can withdraw it at any time. The withdrawal of your consent does not affect the lawfulness of the processing carried out on the basis of the consent prior to the withdrawal. Depending on your country of residence, you can withdraw consent regarding the use of cookies and similar technologies and regarding the processing of personal data collected by these means in particular via our Cookies & Ad Choices Preference Centre (which you can navigate to via the “Cookies & Ad Choices” link available in the footer of our website or the settings menu of our app).

(a) If you are a California resident, California law requires us to provide you with some additional information and rights regarding the “personal information” (as defined in the California Consumer Privacy Act (“CCPA”)) we collect from and about you, and your rights with respect to your personal information. You can find this additional information in our California Privacy Notice.

(b) How We Respond to Do Not Track Signals for California and Delaware Residents: California Business & Professions Code Section 22575(b) (as amended effective January 1, 2014) and the Delaware Online Privacy and Protection Act (“DOPPA”) provides that California and Delaware residents are entitled to know how Michaela! responds to “Do Not Track” browser settings. Michaela! does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created.

Under Nevada law, Nevada residents who have purchased goods or services from us may opt out of the “sale” of “covered information” (as such terms are defined under Nevada law) for monetary consideration to a person for that person to license or sell such information to additional persons. Michaela! does not engage in such “sales” of “covered information,” but if it were to do so in the future, a Nevada resident who has purchased goods or services from us would have the right to submit a request to opt out of future “sales” activity emailing us at [email protected]. Please note we may take reasonable steps to verify your identity and the authenticity of the request.

Additionally, if you are based in France, you also have the right to set guidelines regarding the use of your personal data after your death (Art. 85 French Data Protection Act) and register on the Bloctel list of objection to cold calling, this is a free service (Art. 223-1 French Consumer Code).

The Service may contain content, links or apps that are supplied by a third party, and those third parties may collect usage information and your device identifier when pages from the Service are served to you for their own commercial purposes. In addition, when you are on the Service you may be directed to other sites and apps that are operated and controlled by third parties that we do not control. We are not responsible for the data collection and privacy practices employed by any of these third parties or their sites or apps and they may be tracking you across multiple online services and may be disclosing the results of that tracking with us and/or others. These third parties may have their own terms of service, privacy policies or other policies and ask you to agree to the same. For example, if you “click” on a link, the “click” may take you off the Service onto a different location. These other online services may associate their tracking technologies with you, independently collect information about you, including personal information, and may or may not have their own published privacy policies. We are not responsible for these third-party privacy policies or the practices of third-party owners. Media: If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Embedded content from other websites: Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

This Privacy Notice for California residents supplements the Michaela! Privacy Policy. This Notice applies to website visitors, app users, and customers who are residents of California. This Notice gives California residents additional information about our information collection and use practices required by the CCPA, and also provides California residents with specific privacy rights.

For the purposes of this California Privacy Notice, except where a different definition is noted, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. C. Notice of Right to Opt-Out of Sale and Sharing of Personal Information | California residents may opt out of the “sale” of their personal information. Under the CCPA, “sale” is broadly defined to mean the disclosure of personal information with third parties who are not acting as our service providers or who are otherwise not restricted from using data only on our behalf or pursuant to an applicable CCPA exception.

Under the CCPA, “sale” may also include allowing third parties to “collect” certain information, such as IP address, and/or browsing behavior, through cookies and similar technologies, to deliver targeted advertising on the Services or other services. Advertising, including targeted advertising, enables us to provide you certain content for free and allows us to provide you offers relevant to you.

The CCPA also allows California residents to opt out of the “sharing” of their personal information for “cross-context behavioral advertising.” Under the CCPA, this activity is defined as the targeting of advertising to a consumer based on that consumer’s personal information obtained from the consumer’s activity across websites. We “share” information for these purposes to provide more relevant and tailored advertising to you regarding our Services and the services of our partners.

Please note that we respond to and abide by browser-based opt-out preference signals. The CCPA further provides you with the right to not be discriminated against (as provided for in applicable law) for exercising your access, deletion or sale/sharing opt out rights.

The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. Please note that we do not use or disclose sensitive personal information other than for purposes for which you cannot opt out under the CCPA.

D. Retention of Your Personal Information | We will only retain your information for as long as is necessary for the purposes described in this Privacy Policy.

This means that the retention periods will vary according to the type of information and the reason that we have collected the information in the first place. In determining how long to retain information, we consider the amount, nature and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, applicable legal requirements, and our legitimate interests. The purposes for which we process information (as well as the other factors listed above) may dictate different retention periods for the same types of information. For example, if you purchase a subscription to one of our paid services, we will retain your payment history records for a period of time after your purchase for our anti-fraud and legal compliance purposes. If you opt out of email marketing, we maintain your email on our suppression list indefinitely to comply with your request. We may delete or de-identify your information sooner if we receive a verifiable deletion request, subject to exemptions under applicable law. We may retain cached or archived copies of your information.

E. California “Shine the Light” Disclosure | If a company shares “personal information” (as defined in California’s “Shine the Light” law, Civil Code § 1798.83) with third parties for their direct marketing purposes (e.g., to send offers and information that may be of interest to you), California law requires either providing a mechanism by which consumers can obtain more information about such sharing over the prior calendar year, or providing a mechanism by which consumers can opt out of such sharing. As discussed above, we provide an opt out for this sharing.
